The Mandate of National Disability Agency (NDA)
Article 5, of the founding law of the National Disability Agency (NDA) sets out the duties and responsibilities of the National Disability Agency (NDA) include the following:
- The duties and responsibilities of the Agency include designing, developing and implementing programs of the Somali Government’s plan for persons with disabilities, while ensuring equal access to opportunities for persons with disabilities.
- Without prejudice to the provisions of the agency it shall fulfill the other general and specific duties and responsibilities assigned by its founding law as follows:
- a) The Agency has a leading role in the formulation, correction, and clarification of the country’s laws on persons with disabilities;
- b) The Agency is responsible for ensuring that public offices and public places have open spaces that allow people with disabilities to enter;
- C) That the Ministries and other government agencies, in relation to their work concerning persons with disabilities, shall consult with the Agency during the planning period, and in the capacity of its implementation, that the Agency play a role;
- Establish special training centers for the persons with disabilities;
- e) Ensure that people with disabilities at the federal and state levels have full opportunities to share services with the rest of the community, education at home and abroad, job opportunities, health services, general participation in political activities at all levels;
- f) Ensure access to data on persons with disabilities across the country is taken from the general population census;
- g) Ensure the implementation of the National Policy on facilitating the daily activities of persons with disabilities and provide updates to the Ministry of Women and Human Rights Development (MoWHRD);
- h) Ensure that official writings for people with disabilities appear in a way that they can read, such as Braille, sign language, etc.;
- i) Ensure and monitor the Somali government’s full participation in international and regional conventions on the rights of persons with disabilities, and fully implement its obligations and amending the provisions applicable to persons with disabilities which cannot comply with such agreements
- j) Organizing and coordinating conferences involving government agencies and stakeholders with disabilities, which will focus on developing policies for people with disabilities, and analyzing the progress and implementation of National Plans for persons with disabilities?
- k) Check and register people with disabilities;
- l) Search, provide or facilitate access to a variety of tools to assist various categories of people with disabilities;
- m) Manage special funds for the improvement of the lives of persons with disabilities, and report to MoWHRD, and to the Auditor General;
- n) Establish cooperative relationships, both with governmental and non-governmental organizations, in the interests of persons with disabilities;
- o) Facilitate the establishment of an Independent Disability Council, which brings together various sections of persons with disabilities, and will protect the interests of persons with disabilities;
- p) The Agency may do whatever is in the best interests of people with disabilities not covered by this Article;
- The Agency shall have the power to prosecute any person or entity, whether public or private, for violating, opposes, or slows down the implementation of the law on the rights of persons with disabilities and other related laws, through the process of filing lawsuits with public or private entities;
- All public and private institutions, and companies, foreign and private, the United Nations shall provide employment opportunities in the quota for persons with disabilities, on the basis of gender equality, in accordance with this law and international laws and treaties.
